GIVEAWAY ENTRY PERIOD: The entry period for Princess Jewelry Sweepstakes (the “Giveaway) starts April 4thth, 2024 at 12:00 AM Central Standard Time (CST) and will end on April 15th, 2024 at 11:59 PM CST (Giveaway Entry Period). One (1) winner will be selected on or around April 17th, 2024 and notified by Instagram and/or email. Winner will be selected subject to these Official Rules. Entry in the Giveaway does not constitute entry into any other promotion, contest, or sweepstakes. THIS GIVEAWAY IS IN NO WAY SPONSORED, ENDORSED OR ADMINISTERED BY, OR ASSOCIATED WITH FACEBOOK, INSTAGRAM, TIKTOK, TWITTER, OR OTHER SOCIAL MEDIA PLATFORMS.
ELIGIBILITY: The Giveaway is open to current legal residents of the 50 United States. All entrants must be 18 years of age or older or age of majority or older (in those jurisdictions where age of majority is over 18). Princess Jewelry ("Sponsor" or “Princess Jewelry”) employees and their immediate family members (parent, child, sibling and spouse of each) and those living in the same households of each are not eligible. Void elsewhere and where prohibited by law.
HOW TO ENTER: During the Giveaway Entry Period, follow us on Instagram @princessjewelrymn. Like the giveaway post. Tag a friend in the comments on the Instagram post (each tag = one entry, unlimited entries allowed). Bonus: Share the post to your story and tag us for an extra entry. Any use of an automated system to participate is strictly prohibited and will result in disqualification from the Giveaway and all future Princess Jewelry promotions.
WINNERS AND ODDS: On April 15th, 2024, the Sponsor will conduct a random drawing from among all eligible entries timely received. One (1) prize will be awarded, consisting of one (1) lab-grown, 0.25 carat diamond pendant. No substitution, assignment or transfer of any prize is permitted, except by Princess Jewelry, who has the right to substitute a prize with another of comparable or greater value. No returns or exchanges of prizes permitted except at Princess Jewelry’s sole discretion. All taxes in connection with the prize, and the reporting consequence thereof, are the sole responsibility of the prize winner. Prize winner may be sent a tax form 1099, or other appropriate tax document, in the event the average retail value of the prize requires Princess Jewelry to submit such form. Princess Jewelry may require a signed affidavit and/or completed W9 before awarding any prize. Prize winner may be required to pay shipping and handling fees. Princess Jewelry, may in its sole discretion, pay for shipping and handling for winners within our normal delivery areas for those jurisdictions. Any taxes or duties owed for shipping and handling fees will be the sole responsibility of the winner. Princess Jewelry will notify the winner via Instagram to the Instagram handle selected at the time of entry, as applicable, within approximately three (3) days following the drawing. Winner will have three (3) days from the time of notification to respond, otherwise the prize will be forfeited and Princess Jewelry will not select an alternate winner. Princess Jewelry and its agencies are not responsible for any delay or failure to receive notification for any reason, including inactive email account(s), technical difficulties associated therewith, or winner's failure to adequately monitor any email account. Princess Jewelry reserves the right to disqualify any winner should winner be in violation of these Official Rules as determined by Princess Jewelry in its sole discretion.
RELEASE OF LIABILITY: By submitting your Contest entry, you agree to indemnify Princess Jewelry, its agents, representatives, affiliates, subsidiaries directors, officers and employees (collectively, “Indemnified Parties”) from and against any and all liability or causes of action (however named or described) for any injuries, losses and/or damages caused by or resulting from your entry submission, including without limitation: (a) any incorrect or inaccurate information; (b) technical failures of any kind, including, but not limited to malfunctions, interruptions, misprints, or disconnections in phone lines or network hardware or software; (c) unauthorized human intervention in any part of the Contest; (d) any technical or human error which may occur in the administration of the Contest; (e) any injury or damage to persons or property which may be caused, directly or indirectly, in whole or in part, from your participation in the Contest or receipt or use or misuse of any prize; (f) any unpaid taxes that you owe as a result of your participation in the Contest; (g) any infringement by you of a third party’s intellectual property rights; (h) your inability to access or use the prize; and (i) any injury or damage caused or claimed to be caused by participation in the Contest or acceptance or use of the prize. Neither of the Indemnified Parties shall be responsible for any expenses incurred by you in connection with your participation in this Contest.
YOUR REPRESENTATIONS AND WARRANTIES: By submitting your entry, you represent and warrant that you: (a) are the exclusive owner of the contents of your submission and that you have all rights, approvals and/or consents necessary to submit such content; (b) your submission does not and will not violate these Contest Rules; (c) your submission does not infringe on the rights of any third parties; and (d) the information you provided in your entry is truthful and accurate.
PRIVACY AND USE OF GIVEAWAY INFORMATION: Princess Jewelry collects personal information from you when you enter this Giveaway. All entrant information is subject to Princess Jewelry’s Privacy Policy. Princess Jewelry reserves the right to use any information collected in accordance with its Privacy Policy. Except where prohibited, participation in the Giveaway constitutes entrant's consent to Princess Jewelry’s use of entrant's name, prize information, likeness, voice, opinions, biographical information, hometown and state and all or a part of entrant's entry for promotional purposes in any media without payment or consideration, and without notice to, or prior review or approval from, entrant. Within five days of receiving notice, Princess Jewelry may also require potential winner to sign an affidavit of eligibility, liability release and a publicity release that, among other things, will allow Princess Jewelry to use entrant's name, photograph, likeness, voice, prize information, and biographical information for publicity and promotional purposes without further compensation, and without notice to, or prior review or approval from, entrant, where permitted by law.
Notice of Financial Incentive (California residents): This Giveaway may be considered a “financial incentive” under the California Consumer Privacy Act because we are giving entrants something in exchange for the collection and retention of their personal information. The value of such personal information is related to the value we offer to entrants for participation in the Giveaway and varies based on several factors, including whether entrants respond to marketing offers from us or subsequently opt out, as well as our costs associated with administering the Giveaway. Participation is voluntary, and you may opt out of the Giveaway at any time by emailing customerservice@princessjewelry.com.
CHOICE OF LAW AND JURISDICTION: Except where prohibited, each entrant agrees that: (1) any and all disputes, claims and causes of action arising out of or connected with this Contest or any prize awarded shall be resolved individually, without resort to any form of class action, and exclusively by state or federal courts situated in Minneapolis, Minnesota, (2) entrant waives his or her right to trial by jury in connection with any claims and causes of action arising out of or connected with this Contest or any prize (3) any and all claims, judgments and awards shall be limited to actual out-of-pocket costs incurred, but in no event attorneys' fees; and (4) no punitive, incidental, special, consequential or other damages, including without limitation lost profits may be awarded (collectively, "Special Damages"), and (5) entrant hereby waives all rights to claim Special Damages and all rights to have such damages multiplied or increased. Minnesota State law, without reference to Minnesota’s choice of law rules, governs the Contest and all aspects related thereto.
